In Ontario, probate may be needed to confirm or grant authority to manage an estate, especially when real property must be sold. Ontario states that if the deceased’s real property must be sold, a Certificate of Appointment of Estate Trustee or Small Estate Certificate should be obtained before anyone enters into an Agreement of Purchase and Sale.
